06/08/2018 Letter sent to counsel re: Appellate counsel filed a brief in which he raised no issues and asked the court to review the record independently under People v. Wende (1979) 25 Cal.3d 436. After considering the record, the court has concluded it would benefit from additional briefing. (Gov. Code, ยง 68081.) The trial court sentenced defendant to state prison but imposed a domestic violence fund fee of $500 under Penal Code section 1203.097. It appears that the fee was not authorized because defendant was not placed on probation. Each party may submit a supplemental letter brief not exceeding two single-spaced pages by June 18, 2018, addressing this issue. Oral argument, if not waived, will be held on July 12, 2018, at 1:30 p.m.

The trial court shall correct the minute order for August 17, 2017, to reflect deletion of this fee and to reflect that defendant's sentence was imposed under section 667, subdivisions (b)-(i). As modified, the judgment is affirmed. The clerk of the superior court is directed to prepare an amended abstract of judgment reflecting these changes and to send a certified copy of the amended abstract of judgment to the Department of Corrections and Rehabilitation.
