Status: Final The judgment of dismissal and the order sustaining the demurrer to the first amended complaint are reversed with respect to the cause of action against defendant Biter pursuant to Government Code section 840.2 for injury from a dangerous condition of property. The case is remanded to the trial court for further proceedings and the trial court is directed to overrule the demurrer with respect to that issue. The trial court is further directed to reconsider Jackson's motions for a physical examination and appointment of an expert witness as stated in this opinion. The judgment is affirmed in all other respects. The parties are to bear their own costs on appeal. Smith, Levy, Gomes (25 pages)
