|
ORDER: The defendant was convicted in the District Court of burning a motor vehicle and of operating under the influence of intoxicating liquor, fourth offense, and appeals from an order, by a single justice of this court, denying his motion for a stay of execution of sentence. See Mass.R.A.P. 6(b), as appearing in 454 Mass. 1602 (2009). His direct appeal has been decided by another panel of this court, which affirmed the judgments. See Commonwealth v. Bigley, 85 Mass. App. Ct. 507 (2014) (the decision issued on June 24, 2014, and issuance of the rescript was stayed until July 28, 2014). Even if his sentence had been stayed pending appeal, the stay would have expired. See Mass.R.A.P. 6(b)(5). This appeal is now moot.
