08/11/2016 ORDER: The defendant seeks to appeal the Superior Court's February 12, 2016 denial of his motion for new trial. On June 27, 2016, the defendant filed a motion to extend to time for filing a notice of appeal in the Superior Court, which was allowed by the Superior Court (McDonough, J.) on June 28, 2016. The notice of appeal was then filed on July 11, 2016. Accordingly, the defendant is ordered to show cause, in writing to move for voluntary dismissal of the above-captioned appeal pursuant to M.R.A.P. 29(b), or to show cause, in writing, why jurisdiction over this appeal is proper, or file a motion for voluntary dismissal pursuant to Mass. R. App. P. 29(b), or file a motion for enlargement of time to file a notice of appeal pursuant to Mass. R. App. P. 14(b). The failure to taken action by August 25, 2016 may lead to dismissal of this appeal for lack of prosecution. *Notice/Attest.
