Description: Affirmed but sentence modifications ordered

Status: Final The December 7, 2015 sentencing minute order is modified to reflect that the $30 criminal conviction assessment (Gov. Code, § 70373) and the $40 court operations assessment (Pen. Code, § 1465.8) are separate orders and not conditions of probation. The trial court is directed to prepare a new sentencing minute order, and, if appropriate, a new abstract of judgment, and to forward the new abstract of judgment to the Department of Corrections and Rehabilitation. As modified, the judgment is affirmed.
