06/28/2013 #5 RE#1 The appeal that the plaintiff seeks to enter is from an order of the Superior Court vacating his indigency status in the underlying proceeding. The plaintiff has now filed a motion to docket his appeal late without paying the required fee on the ground of indigency. In order not to prejudge the merits of the plaintiff's appeal, and after reviewing his affidavit of indigency, his motion to waive the fee for filing his motion to docket his appeal late is allowed. Based on the affidavit of indigency and additional information provided, instead of the ordinary filing fee, the plaintiff shall be required to pay only a lump sum payment of $34.68 in order to proceed. The Court further finds that requiring additional installment payments would create an undue administrative burden for the court. In light of the subject matter of the appeal, this order shall be subject to revision by the panel designated to decide the appeal. The appellant's name and the Appeals Court docket number must be noted on each remittance. Payment is to be made by check or money order payable to the Commonwealth of Massachusetts within 14 days of the date of this Order.
