12/07/2010 #3 ORDER: The court treats the paper submitted by defendant, Liquiang Wei, on December 1, 2010, as a request for leave to file a notice of appeal late pursuant to Mass.R.A.P. 14(b). See Zullo v. Goguen, 423 Mass. 679 (1996). The appeal would challenge the abuse restraining order entered by the District Court on July 30, 2010. The court DENIES leave to pursue a late appeal from the restraining order of July 30, 2010. The paper submitted by Mr. Wei fails to demonstrate a meritorious or substantial question for appellate consideration. See Tisei v. Building Inspector of Marlborough, 3 Mass. App. Ct. 377, 379 (1975). In addition, to the extent that the defendant's paper requests the single justice to reverse the District Court's denial of his motion to vacate the abuse restraining order, entered on November 22, 2010, the request is denied. The single justice is without authority to grant such relief. See Zullo v. Goguen, 423 Mass. 679 (1996). Even if the single justice had such authority, and if the request were timely, the request would be denied because it nonetheless fails to present any issue of arguable merit or substance for appellate consideration. Finally, the court observes that the abuse restraining order expires on July 29, 2011, at 4:00 p.m. If Mr. Wei's wife or son propose to extend the order beyond that time, he may request, and shall be entitled to, a hearing in the District Court at which he may present his position to a judge.
