11/01/2012 #2 ORDER: On October 26, 2012, the plaintiff filed a petition, pursuant to G. L. c. 231, § 118 (first par.), seeking review of an order of the Middlesex Superior Court, entered September 14, 2012, in which the court allowed the defendants' motion for the court to order third-party defendant Albitt-Scofield, PC, to place $502.396 in escrow with the court to pay defendant Zambia Corporation's payroll and outstanding debt. The plaintiff failed to file a timely § 118 petition for review of the trial court's September 14, 2012 order. See G. L. c. 231, § 118 (first par.) ("A party aggrieved by an interlocutory order of a trial court justice in the superior court department ... may file, within thirty days of the entry of such order, a petition in the appropriate appellate court seeking relief from such order"). The filing of a motion for clarification in the trial court does not toll or enlarge the thirty-day period set forth in G. L. c. 231, § 118 (first par.). Cf. McGrath v. McGrath, 65 Mass. App. Ct. 670, 671 (2006). Even if the petition had been timely, to the extent that the plaintiff seeks a writ of prohibition, relief is unavailable under G. L. c. 231, § 118 (first par.). A single justice's authority is limited to the relief authorized by the statute (Sullivan, J.). Notice/attest/Wilkins, J.
