11/18/2011 #5 ORDER: The plaintiff seeks review of an order of the Superior Court that he "execute a general release for Counsel of the Defendant to obtain the records [from the Massachusetts Department of Transitional Assistance Application and file and the Social Security Disability Insurance application and file] forthwith." The plaintiff not unreasonably construes the court's order to execute a general release to authorize the S.S.A and the D.T.A. to release the documents directly to counsel prior to any in camera review of the documents by the court. The defendant, in her opposition to the petition, concedes that in camera review of the documents at issue is appropriate, and should be conducted by the court prior to the release of any documents to counsel. See defendant's opposition at p 6. See also G.L. c. 233, § 20B. Plaintiff requests precisely this procedure in "Relief Requested One." Accordingly, the matter is remanded to the trial court for reconsideration and/or clarification of the judge's order in light of the foregoing, and the judge shall file a new order on or before December 1, 2011.
