06/06/2011 #16 ORDER ON DEFENDANTS' MOTION TO STAY OR MODIFY INJUNCTION PENDING APPEAL AND TO EXPEDITE APPEAL: Before entering the Order of the Single Justice, dated February 28, 2011, denying defendants' Application for Stay or Modification of Injunction (an Order later vacated in its entirety on March 9, 2011 on procedural grounds), I familiarized myself with the parties' voluminous written submissions and conducted a lengthy hearing. Although I was constrained to vacate the February 28, 2011, Order on March 9, 2011, for the sake of judicial economy I retained jurisdiction over the matter should the parties subsequently seek similar relief after final determination of the then pending post-judgment matters and after the filing of an appropriate notice of appeal. The defendants have now again moved to stay or modify the injunction entered as part of a final judgment of the Superior Court on January 27, 2011, and request a hearing on their motion. They also seek to expedite the appeal. I have reviewed the parties' written submissions in support of and in opposition to the newly filed motion and discern no need for a hearing. For substantially the reasons set forth in my February 28, 2011, Order as well as in the plaintiff's May 27, 2011, opposition to the motion, the motion to stay or modify injunction pending appeal is denied. Simply put, nothing has been made to appear in the defendants' motion that persuades me the relief requested is warranted. That being said and for the sake of clarity, the pending appeal is to be expedited and will be placed on the September, 2011 list for panel consideration. The briefing schedule as it now stands shall remain in place with the defendants' brief to be filed on or before June 14, 2011, and all responsive briefs to be filed in accordance with the time limits stated in Mass.R.A.P. 19(a) and 14(c).
