11/27/2012 #2 ORDER: The defendant appeals, pursuant to G. L. c. 261, § 27D, from a Probate and Family Court judge's order disallowing a portion of the funds defendant requested in his motion for funds for a transcript. Under G. L. c. 261, § 27C(4), "[t]he court shall not deny any request without first holding a hearing thereon." As it does not appear from the trial court docket that such a hearing was held, appellate proceedings are hereby stayed until December 28, 2012, for the motion judge to hold the requisite hearing and/or for the Hampden Probate and Family Court to transmit updated copies of the docket to this court. 12/07/2012 #4 ORDER: The defendant appeals, pursuant to G. L. c. 261, § 27D, from a Probate and Family Court judge's determination and findings disallowing a portion of the funds defendant requested in an application for funds for a transcript. While this court has received a copy of the Probate and Family Court's Findings after hearing, Determination Regarding Fees and Costs, and updated docket, it requires copies of the defendant's underlying application for fees and costs, accompanying affidavit, and any other supporting documentation filed by the defendant below. Accordingly, the Probate and Family Court shall transmit copies of Docket entry numbers 117 and 118 forthwith. (Sikora, J.) *Notice/Attest.

12/19/2012 ORDER: After a hearing, a judge of the Probate and Family Court calculated that a full trial transcript would approximately cost $900.00. The judge granted the appellant, Stephen Burrell, $500.00 toward that amount and observed that he should be able to designate only portions of it for purposes of an effective appeal. The present records show no error of law or abuse of discretion. I therefore DENY the present appeal from the trial court's order. (Sikora, J.). *Notice/Attest/Fuller, J.
