Appellant's application for extension of time to file the opening brief is denied. Appellant has previously been granted an additional 98 days to file an opening brief. We have reviewed the file, and it is apparent the only record Appellant requested was the index; not the entire clerk's transcript. Further, appellant was emailed the requested index. Appellant indicated in his December 21, 2017 extension request that he arranged with "Clerk Darien" on December 15th to have it emailed to him, but he had not received it as of December 18th. Appellant has failed to demonstrate he made any effort to remedy the error since that time, despite asserting "the incorrectly addressed email never arrived." The email chain to which Appellant refers in his application was not attached to the application and the Court has no record of it. |
