The defendants' response shall specify any documents that have been provided in response to the plaintiffs' discovery request for email messages regarding the plaintiffs by and between Richard Livingston, Marc Bellora, Director of Berkshire Housing Services, Inc. aka/BHSI, managing agency for Williamstown Elderly Housing Inc., aka/WEHC, owners of the property, and others. The response shall also specify whether and why any documents that would otherwise satisfy that request were withheld. Finally, the response shall also detail whether and how the defendants complied with Superior Court Standing Court Order 1-09, paragraph 3, with respect to any such document or documents that were so withheld. 06/20/2013 #7 ORDER: The defendants' response to my June 6 order does not indicate that all documents covered by the plaintiffs' request for documented communications between the defendants and certain other entities and individuals regarding the plaintiffs (contained in the paragraph numbered 5 in the addendum to the plaintiffs' subpoena) have been turned over to the plaintiffs. The defendants assert only that the plaintiffs are in control of communications "regarding" Richard Livingston. In view of this, the order denying the motion to compel is vacated and the matter is remanded to the Superior Court which shall determine whether any communications responsive to this request have not been disclosed, and order the disclosure of any such documents as appropriate.
