11/04/2010 ORDER: "This matter came on for hearing before the single justice on November 3, 2010. The plaintiffs appeared and the defendant did not. At the hearing, the plaintiffs advised that the tenant vacated the premises on October 4, 2010, but that they were required to spend three weeks cleaning and preparing the apartment for occupancy by reason of the condition in which the defendant left it. Accordingly, the amount established as an appeal bond is appropriate insofar as it includes use and occupancy for October, 2010. However, by reason of the defendant's departure, there is no need for continuing payments of use and occupancy for the period beginning November 1, 2010 and thereafter. Therefore, the order on the defendant's motion to waive appeal bond is modified to eliminate the obligation for payment of use and occupancy for the period beginning November 1, 2010 and thereafter, but is otherwise affirmed."
