01/07/2013 #3 ORDER: The plaintiff seeks review under G.L. c. 231, § 118 (1st para.) from a protective order entered by the Superior Court (Billings, J.) on November 21, 2012, protecting communications of the defendant law firm with its in-house ethics advisor from discovery by the plaintiff client suing the firm for malpractice on the grounds of attorney-client privilege. Without suggesting any view on the merits or the disposition of this litigation, because there is a conflict amongst jurisdictions, I believe that the case should be considered by a panel of this court. Accordingly, I grant the plaintiff leave to take an interlocutory appeal of the legal question presented to a panel of this Court for decision, after briefing and further argument. See Mass.R.A.P. 5. The plaintiff shall be treated as the appellant and the defendants as the appellees. The matter shall be entered on the docket as 2013-P-26 without the payment of a further fee. The appellant's brief and joint appendix shall be filed no later than January 21, 2013; the appellees' brief shall be filed no later than February 5, 2013; and any reply shall be filed no later than February 10, 2013. No enlargement of time for filing briefs may be requested. The appeal shall be scheduled for argument on February 11, 2013. So ordered. (Katzmann, J.) *Notice/Attest.
