12/24/2010 #2 ORDER: The court has considered the petition of the Town of Hanson and Richard Harris as its Highway Superintendent for relief pursuant to G. L. c. 231, § 118, first paragraph. In effect the petitioners request the single justice to vacate the rulings of two Superior Court judges allowing the plaintiffs to assert a claim (Count III) under the Massachusetts Civil Rights Act against petitioner Harris as a municipal official. Allowance of the request would cause dismissal of the claim. Massachusetts R. App. P. 15(c) prohibits a single justice to dismiss or otherwise impose a final determination of a claim. Therefore, the court DENIES the interlocutory relief requested under G. L. c. 231, § 118, first paragraph, without prejudice to the petitioners' rights to prosecute any defenses against the claim in the Superior Court. (Sikora, J.) *Notice/Attest/Image.
