12/20/2012 #3 ORDER: Upon consideration of plaintiff Nordberg's petition and of the defendant's Superior Court opposition papers as adopted by the motion judge, I DENY (1) relief from the motion judge's rejection of plaintiff's request to submit a fifth amended complaint, and (2) relief from the motion judge's denial of his request for entry of a default judgment. GROUNDS 1. The plaintiff has not demonstrated any abuse of discretion by reason of the preclusion of a fifth amended complaint. See Castellucci v. United States Fidelity and Guaranty Co., 372 Mass. 288, 289-290 (1977). Four complaints are enough. 2. Defendants have no duty to submit a new answer to a more definite statement of a claim if their prior answer categorically addressed it.
