12/19/2012 #4 ORDER: Third-party defendant, David P. Ashley, filed a petition pursuant to G. L. c. 231, § 118 requesting that the single justice vacate the "Order for Injunction" entered in the Superior Court on October 18, 2012. To date, proceedings on the petition have been stayed pending disposition of further motions in the Superior Court. The Superior Court docket reflects that final judgment entered in the Superior Court on December 4, 2012. Moreover, the Superior Court stayed the challenged order pending any appeal filed by Mr. Ashley. Accordingly, this petition is dismissed as moot.
