09/20/2011 #6 ORDER:The plaintiff requests interlocutory relief from adverse findings of a medical malpractice tribunal. After a tribunal issued its findings on June 16, 2011, the plaintiff posted bond, then filed an emergency motion to reduce the amount of the bond "and/or" strike the tribunal's findings. A Superior Court judge ruled on August 5, 2011, reducing the bond to $1,000, and did not vacate the tribunal's findings. No further relief is possible. It is well-settled that there is no statutory provision for an interlocutory appellate appeal from a tribunal's decision. To contest an adverse decision, a plaintiff must post a bond and proceed to trial before seeking appellate review. Ruggiero v. Giamarco, 73 Mass. App. Ct. 743, 745 (2009). The plaintiff acknowledges that she posted a bond so the case could proceed with discovery while awaiting interlocutory review. Accordingly, the petition is denied. (Cypher, J.)
