04/06/2011 #2 ORDER: To the extent the petitioner is seeking relief pursuant to G. L. c. 231, § 118, the petition must be denied, as the order dismissing the plaintiff's appeal is not an interlocutory order as contemplated under the statute. The proper remedy for the dismissal of an appeal is the filing of a notice of appeal. A review of the trial court's docket shows that the order dismissing the appellant's appeal was entered on June 14, 2010, and a notice of appeal was filed by the appellant on July 23, 2010. The notice of appeal, however, appears to have been filed beyond the thirty-day deadline imposed under Mass.R.App.P 4(a). Therefore, the single justice will elect to treat the within petition as a motion to file a late notice of appeal, and as such, allows the motion nunc pro tunc to July 23, 2010.
