08/25/2011 ORDER: Defendants in this action have brought two petitions pursuant to G. L. c. 231, § 118, first par., seeking relief from an order of the Superior Court allowing the plaintiffs' motion to strike a motion to dismiss purportedly brought on behalf of Ridgewood Electric Power Trust V and Ridgewood Power Growth Fund by a special litigation committee.(3) Under § 118, the single justice reviews an order of Superior Court to determine whether there has been an abuse of discretion or error of law. See Galipault v. Wash Rock Investments, LLC, 65 Mass. App. Ct. 73, 82 (2005). The defendants's petitions demonstrate no error of law in the Superior Court judge's thorough opinion allowing the motion to strike that would warrant reversal of her order, nor any abuse of discretion. Likewise, they have not demonstrated that this case merits the extraordinary and disfavored relief of leave to appeal the matter to a panel of this court. The petitions are therefore denied.
