02/06/2013 #1 Petition pursuant to M.G.L. c. 231, § 118 with attachments, filed by Maura Mahoney, Yeeli Tsang, Brenda Moreira, & Danielle Settipane, Peter Rushton, Fidelity Brokerage Service LLC.
02/12/2013 #2 ORDER: Before me is a petition, pursuant to G. L. c. 231, § 118 (first par.), brought by five proposed deponents and intervenor Fidelity Brokerage Services LLC, seeking interlocutory relief from an order of the Superior Court, dated January 7, 2013, denying their motion to quash subpoenas and for protective orders, or in the alternative to postpone depositions. After consideration of the arguments presented and the documents submitted, I discern no abuse of discretion or clear error of law with respect to the trial court judge's determination that the depositions may go forward. See Jet-Line Services, Inc. v. Board of Selectmen of Stoughton, 25 Mass. App. Ct. 645, 646 (1988). Accordingly, the petition is denied. (Cohen, J.) *Notice/Attest/Brieger, J.
