08/22/2011 #6 IMPOUNDMENT NOTE: The Defendants' Appendix of Supplemental Materials (Paper No. 14 on the Superior Court docket) is impounded and sealed. Pursuantto Superior Court directives, it has not been accessible to the general public or to the Plaintiffs or their counsel, and was submitted onlyfor in camera review. In this action, the Plaintiffs seek relief from orders by which the Superior Court impounded and sealed applications for warrants tosearch their property, and related documents, based on a finding of good cause. The appendix contains copies of those very documents. It also contains a prosecutor's affidavit that comments on the substance of such documents and explains why their disclosure would beharmful to an ongoing investigation. Accordingly, the appendix was filed under seal and impounded by direction of the Superior Court.Revelation of the contents of the appendix would effectively render the Defendants' appeal moot and irreversibly damage lawenforcement efforts.
