02/20/2013 #1 Petition pursuant to M.G.L. c. 231, § 118 with attachments, filed by Michael S. O'Brien.
02/27/2013 #2 ORDER: Before me is the plaintiff's petition, pursuant to G. L. c. 231, § 118 (first par.), seeking interlocutory relief from an order of a judge of the Superior Court denying the plaintiff's motion to compel the production of documents, which, the defendants assert, are protected from discovery by the attorney-client privilege and the work product doctrine. It is only in extraordinary circumstances that a single justice will disturb a discovery order of the trial court, such as where a party asserting a credible claim of privilege has been ordered to produce discovery. This is not such a case. Furthermore, after review of the judge's ruling on waiver, I discern no clear error of law or abuse of discretion that would warrant single justice intervention in this case. See Jet-Line Services, Inc. v. Board of Selectmen of Stoughton, 25 Mass. App. Ct. 645, 646 (1988). Accordingly, the petition is denied (Cohen, J.). Notice/attest/Leibensperger, J.
