12/22/2011 #13 ORDER: Due to an oversight, this Court did not state in its Memorandum and Order Pursuant to Rule 1:28 that the appellant was entitled to attorney's fees and costs. Consequently, treating appellant's letter to this Court as a Petition for Rehearing, his request for reasonable attorney's fees and expenses pursuant to G. L. c. 152, ยง 12A is granted. In accordance with the procedure described in Fabre v. Walton, 441 Mass. 9, 10 11 (2004), within fourteen days of the date of this order, Fisher shall file with this court and serve on the insurer a motion for determination of the amount of its appellate attorney's fees and costs, supported by an affidavit detailing such fees and costs. The insurer may, within fourteen days thereafter, file with this court and serve on Fisher any opposition. (Mills, Sikora & Rubin, JJ.). *Notice.
