01/10/2011 ORDER: This appeal, entered as 10-P-1723, is hereby vacated as having been entered in error and the case is closed. The appeal was entered incorrectly as a direct appeal. Upon review, the notice of assembly indicates that the defendant appealed from the denial of his motion for state payment of fees associated with the cost for production of a transcript of his trial court proceedings, and therefore the appeal should have been entered on the single justice docket pursuant to G. L. c. 261, § 27D. On this date, the defendant's appeal is entered as 11-J-13, pursuant to G. L. c. 261, § 27D. The brief and appendix filed by the defendant on November 26, 2011, are retained by the court and will be entered on the docket in 11-J-13. In accordance with G. L. c. 261, § 27D, the appeal will proceed in normal course for decision by the single justice. Notice/attest/image
