12/20/2012 #2 ORDER: Plaintiff Lemanski's petition pursuant to G. L. c. 231, § 118 (1st para.) seeks review of a protective order issued by the Worcester Superior Court concerning a deposition. The motion for protective order was allowed on October 4, 2012. Plaintiff moved for reconsideration in the Superior Court on November 15, 2012, which motion was denied on November 21, 2012. The petition, which was not filed until December 19, 2012, is untimely under G.L. c. 231, § 118. See McGrath v. McGrath, 65 Mass. App. Ct. 670 (2006)(the filing, in the trial court, of a motion for reconsideration of an interlocutory order does not enlarge or create a new 30-day time period for bringing an appeal from the interlocutory order).
