02/13/2006 RE#10 Prior to his appointment to the Appeals Court in March of 2001, Justice Kafker served as chief legal counsel to the Massachusetts Port Authority. There, he selected Martin Healy to serve as outside legal counsel on a number of significant environmental legal issues involving Massport. Although Justice Kafker does not believe this will in any way affect his impartiality on this matter, he wanted to disclose this to the parties in the instant case. Should either side request his recusal, he will do so and be replaced by another justice of this court.
