11/30/2011 ORDER: This petition seeks relief from a mutual order issued against the plaintiff, sua sponte, purportedly pursuant to G. L. c. 209A, § 3, despite the fact that the defendant filed neither a complaint nor an affidavit in support of the order. See Uttaro v. Uttaro, 54 Mass. App. Ct. 871, 875 (2002). Nor does the record before this court contain the written findings that the statute requires. See Sommi v. Ayer, 51 Mass. App. Ct. 207, 211 (2001). Nonetheless, because the mutual restraining order is a final order, and not an interlocutory order, the petition is improperly filed before the single justice. See G. L. c. 231, § 118.
