M.S., Case No. B268529 Dear Counsel: M.S. appeals the juvenile court's jurisdiction finding as it relates to him and the disposition order removing the three oldest children from the care and custody of both parents. He does not challenge the court's order releasing the two youngest children to their mother under the supervision of the Department. A minute order from the dependency proceedings on April 25, 2016 states the court entered a home-of-parent-mother order as to the three oldest children and, as a result, all five children are now residing with their mother. (A copy of the minute order is attached.) A Welfare and Institutions Code section 364 review hearing is scheduled for October 24, 2016. Please answer the following three questions in a short, written response filed with this court no later than August 22, 2016: (1) Is father currently residing with the children's mother; (2) What is the current visitation order for father as it relates to the five children; (3) Does father still challenge the disposition order to the extent it removed the three oldest children from his care and custody in view of the children's return to their mother under the Department's supervision? Counsel are instructed to e-file their written submission at 2d1.clerk7@jud.ca.gov.
