10/29/2002 Decision: Rule 1:28 (J D GN). The judgment dated August 25, 1999, on the complaint for modification is affirmed. So much of the judgment dated August 25, 1999, on the complaint for contempt, as (1) adjudges the husband to be not in contempt with respect to the payment of alimony, and (2) orders that no counsel fees are to be awarded on account of this matter, is reversed, and the matter is remanded to the Probate Court for entry of a judgment of contempt on the complaint for contempt and further proceedings (including such hearing as may be necessary) on the issue of counsel fees. In all other respects, that judgment is affirmed. The orders dated September 10, 1999, denying the husband's motions to amend the judgments on complaint for modification and complaint for contempt are affirmed. So much of the corrected judgment dated November 12, 1999, on the complaint for contempt as (1) adjudges the husband not to be in contemp, (2) orders that neither party is to be awarded counsel fees, and (3) denies the wife's request for reimbursement of travel related costs is reversed, and the matter is remanded to the Probate Court for further proceedings consistent with this opinion. In all other respects, the corrected judgment is affirmed. *Notice (See image on file.)
