Rule 6(a) of the Massachusetts Rules of Appellate Procedure specifies that a motion for such stay must ordinarily be sought in the first instance in the lower court unless the motion shows "that application to the lower court for the relief sought is not practicable." Because the motion before me does not show that it is not practicable to seek the relief sought in the lower court in the first instance, the motion is denied without prejudice to refiling should that relief be denied by the lower court judge. R.A.P. 6(a) by not first seeking a stay in the trial court. Instead they sought reconsideration of the judge's order vacating their pro hac vice admission to assist in the defense of the underlying case. In their renewed motion in this court the petitioners essentially dispute the judge's findings. Substantive consideration of the judge's findings is not available on interlocutory review.
