08/02/2011 ORDER: In accordance with our decision in the above-captioned appeal awarding the defendant his appellate attorney's fees and costs, the defendant has filed an application for such fees and costs, with appropriate supporting materials. After review of the defendant's application, and the plaintiff's opposition memorandum, we conclude that the amount of time spent by counsel on this appeal and counsel's hourly rates are reasonable. We also conclude that the costs incurred on appeal are reasonable. Accordingly, we hereby award to the defendant his attorney's fees in the amount of $2,863.50 (two thousand eight hundred sixty three dollars and fifty cents) and costs in the amount of $79.79 (seventy nine dollars and seventy nine cents). This award is assessed against, and to be paid by, the plaintiff, Lee Blais, and not his attorneys. This order may be enforced as an order of the trial court (Cypher, Fecteau & Milkey, JJ.). *Notice/Attest.
