12/11/2012 RE#2: The petitioner has filed a Motion for Immediate Decision on Denial of Application for Waiver of Fees , in connection with his appeal from a trial court order dated October 18, 2012, denying his request for waiver, substitution, or payment by the Commonwealth of fees and costs. The petition is filed pursuant to G. L. c. 231, §118 (first par.) The Legislature has enacted and specified the proper route for appellate review of orders relating to indigency appeals. See G. L. c. 261, §27D. The statute does not contemplate review by the single justice in the absence of an appeal properly entered pursuant to the statute. Notwithstanding the procedural posture, it has been made to appear that the trial court has reconsidered the motion and on December 6, 2012, allowed the requested relief.
