09/23/2013 #4 ORDER: On two occasions in July, 2013, petitioner attempted to file a motion for State payment of costs or fees in connection with his divorce action. The register of probate refused to docket the motions, and accordingly, the motions were never presented to the trial court for review and decision. As a general rule, the clerk's office should have docketed the motion and presented it to the trial judge for review and decision. G. L. c. 261, § 27C. See, generally, Costello v. Lexington, 450 Mass. 1004 (2007). Accordingly, the register of probate is to forthwith docket the motion and present it to the trial court for review and decision pursuant to the provisions of G. L. c. 261, § 27C. So ordered. (Cypher, J.) *Notice/Attest/Christopher, J.
