For the reasons set forth in the defendant's submissions to the single justice, a temporary stay is granted with respect to those portions of the Judgment scheduled to take effect on August 1, 2013 and August 7, 2013 until further order of this court or a single justice thereof. 08/07/2013 #6 ORDER: The defendant husband seeks a stay of so much of the Probate and Family Court's Judgment of Divorce Nisi, entered on July 9, 2013, which was scheduled to take effect on August 1, 2013 and August 7, 2013. A temporary stay was entered by this single justice on July 31, 2013. Upon careful review of the entire record submitted in support of the petition, the temporary stay previously granted is hereinafter revised to extend only until such time as a judge of the Probate and Family Court holds a hearing and issues an order on the defendant's Motion for Stay pending appeal which the defendant filed on July 29, 2013. Such hearing shall take place in the Probate and Family Court no later than August 28, 2013. I note that among the reasons offered by the defendant in support of his motion currently pending in the Probate and Family Court is that he has not been provided with sufficient time to find a suitable location for his dental practice. Although I do not comment on the merits of the defendant's motion, I anticipate that the defendant-petitioner will be prepared to present the Probate and Family Court judge with information regarding his research into alternate office spaces and the amount of time needed to relocate his practice at the hearing.
