05/07/2013 ORDER: In accordance with the procedure outlined in Fabre v. Walton, 441 Mass. 9 (2004), the appellee properly requested attorney's fees in her brief. In our decision in the above-captioned appeal, we deemed appellee's request appropriate and invited a submission detailing and supporting the amount sought within fourteen days of the date of the rescript. The appellee made a timely submission in support of attorney's fees in the amount of $14,847.50 and expenses in the amount of $1,380.08. The attorney's fees sought included $2,400 for work not performed in connection with this appeal, fees which we lack the authority to award under G. L. c. 152, ยง 12A. That amount is denied without prejudice to appellee bringing any appropriate and available application in the appropriate forum. Having reviewed the remainder of the request, we conclude that a reasonable fee is, and order the appellee's fee application granted in the amount of, $10,132.50, and we order the request for expenses granted in full.
