08/03/2012 ORDER ON PETITION FOR REHEARING: The petition for rehearing filed by the plaintiff-appellant in the above matter having been considered, the following is noted. The stipulations of February 1, 2010, and April 5, 2010, were both contained in the record appendix. Although it was stated otherwise in the memorandum and order issued in this matter on April 3, 2012, pursuant to our rule 1:28, the referenced statements were not determinative of any issue in the case. We revise our memorandum and order to delete the last sentences of the first and second paragraphs under "Discussion." To the extent that the memorandum and order indicated that it did not appear that the appellant had raised certain claims below concerning health insurance, it also stated that even if not waived, such claims would be unavailing on appeal. It is ordered that the petition be and the same hereby is, denied. So ordered. (Rapoza, C.J., Grainger & Sikora, JJ.) *Notice.
