04/23/2014 ORDER: Following this Court's decision in the above-captioned case, the defendants-appellees filed a motion for clarification of the decision. The defendants note that the plaintiff's appeal related only to his claims for negligence, two counts out of the six on which the lower court granted summary judgment, but that this Court issued a judgment of reversal without specifying which counts it applied to. Our judgment of reversal applies to the negligence counts, the only counts properly before us on appeal. The defendants' motion for clarification is granted, and the decision has been modified to clearly reflect its scope. So ordered. (Trainor, Vuono & Rubin, JJ.) *Notice/Attest.
04/23/2014 REVISED DECISION: Rule 1:28 (Trainor, Vuono, Rubin, JJ.). So much of the judgment as concerns the negligence claims is reversed; the judgment is otherwise affirmed. *Notice.
