12/03/2012 ORDER: In a memorandum and order pursuant to rule 1:28 issued March 12, 2012, this court affirmed a Superior Court judgment awarding trial-level attorney's fees and costs to John Hancock Insurance Co. (Hancock), the stakeholder in an interpleader action.[1] We concluded that the appeal to this court by interpleader-defendant Flaherty was frivolous. We therefore granted Hancock leave to request attorney's fees and costs. Hancock submitted the appropriate petition with supporting documentation. Hancock's attorney, Mr. Rooney, worked 8.4 hours at an hourly rate of $350 and also incurred costs of $950.17. The brief on behalf of Hancock, written by Attorney Rooney, was well done, and the time the attorney expended was productive. The request for attorney's fees and costs of $3,890.17 is reasonable, and we grant it in full. This order may be enforced as an order of the trial court. So ordered.
