12/23/2011 ORDER OF DISMISSAL: On March 14, 2011, the plaintiff, John Cooper, filed some twenty-three complaints in the Superior Court against twenty-three separate corporate and individual defendants. All were eventually dismissed either on the court's own initiative or upon motion by the defendant, pursuant to Mass. R. Civ. P. 12(b). After filing notices of appeal in each action, the Appeals Court consolidated and entered three of Mr. Cooper's appeals on August 19, 2011, as 11-P-1454, and on October 25, 2011, seven additional appeals were consolidated and entered as 11-P-1833. For purposes of this order the court elects to consolidate 11-P-1454 and 11-P-1833 for final determination as stated herein. As it has been made to appear, by way of letter, dated December 6, 2011, filed by Mr. Cooper's court-appointed Successor Permanent Guardian, Michael Azzara, Esq.,(2) that the Guardian neither consented to nor had knowledge of the filing of the Superior Court actions and the resulting appeals, the appeals must be dismissed, as Mr. Cooper lacked the legal capacity to file the underlying actions and to prosecute the resulting appeals absent the necessary consent of his Guardian.
