The single justice is without authority to grant the relief requested, insofar as it would be outcome determinative. See Mass.R.A.P. 15(c). Although the defendant has not, in terms, requested leave to take an interlocutory appeal, I have considered that possibility. After review of the issues raised in the petition, as well as the age and trial-ready status of the case, I decline to exercise my discretion to grant such extraordinary relief in these circumstances."
