03/29/2012 OPPOSITION to paper #12, filed by William J. Bougioukas.
03/30/2012 RE#12: On 3/26/12, the appellee's brief, with supplemental appendix attached, was not accepted for filing, as the appellee did not seek leave to file a supplemental appendix. The instant motion questions the propriety of the contents of the supplemental appendix, arguing that it contains documents not relevant to the issue on appeal, and that some of the documents contain handwritten notations that were not before the trial court. To the extent the motion questions the relevance of the documents, it is referred to the panel designated to decide the appeal for a determination of the propriety of the inclusion of the documents. Concerning the issue of documents containing the handwritten notations, the appellee is to, on or before 4/05/12, and in accordance with the notice of rejection, dated 3/26/12, file a motion for leave to file a supplemental appendix, which addresses reasons why the documents containing the handwritten notations should not be struck. (Milkey, J.). *Notice.
