10/04/2012 ORDER: On April 20, 2012, the Appeals Court issued a memorandum of decision and order pursuant to rule 1:28 that affirmed the decision of the reviewing board. Subsequently, as neither a petition for rehearing nor application for further appellate review were timely filed, see Mass.R.A.P. 27 and 27.1, the rescript issued on May 18, 2012, pursuant to Mass.R.A.P. 23. On June 7, 2012, the defendant, Savers Property and Casualty Insurance Company filed a petition for rehearing. The petition for rehearing was filed late, see Mass.R.A.P. 27(a), and therefore is denied as untimely. Nevertheless, in the interest of justice, the panel reviewed the petition for rehearing and determined that it is not meritorious (Kantrowitz, Wolohojian & Sullivan, JJ.). *Notice.
