Entry Date Paper Entry Text
09/08/2011 #1 Petition pursuant to M.G.L. c. 231, ยง 118 with attachments, filed by Jacqueline Graham, Daniel Graham, and Jacob and William Graham by their father and next friend, Daniel Graham.
09/16/2011 #2 Opposition to Petition with attachments, filed by Mary C. Boyd, M.D.
09/21/2011 #3 .ORDER: The plaintiffs seek review of a Superior Court order of August 8, 2011, denying reconsideration of an earlier order which denied the plaintiffs' motion to strike adverse findings of a medical malpractice tribunal, and denied reduction in the amount of the $6,000 bond ordered by the tribunal. The plaintiffs' request for relief from the adverse findings is denied because there is no statutory provision for an interlocutory appellate appeal from a tribunal's decision. Ruggiero v. Giamarco, 73 Mass. App. Ct. 743, 745 (2009). The plaintiffs' request, on grounds of indigency, for a reduction in the amount of the bond also is denied for the reason that the bond has already been posted so as to allow the case to proceed. Ruggiero v. Giamarco, ibid. (Cypher, J.) *Notice/Attest. Footnote: 1. Daniel Graham, and Jacob and William Graham, by their father and next friend Daniel Graham. 2. Essex County Ob/Gyn Associates, Inc.
