This court has received a notice of appeal filed on September 5, 2017, in which petitioner, the prospective adoptive parent for J.D., seeks to challenge an August 30, 2017, juvenile court order removing J.D. (who has been freed for adoption) from her custody. Such orders are not directly appealable and must be challenged by way of a writ proceeding (see Welf. & Inst. Code, § 366.28; Cal. Rules of Court, rules 8.454 & 8.456). In order to challenge the removal order, petitioner was required by rule of court to file a notice of intent within seven days of the August 30, 2017, hearing date. (Cal. Rules of Court, rule 8.454(e).) This court will treat the notice of appeal as a timely notice of intent and deem this matter a writ proceeding pursuant to California Rules of Court, rules 8.454 and 8.456. The Fresno County Superior Court clerk is hereby directed to prepare, certify and serve the record in these proceedings according to California Rules of Court, rule 8.454(h)-(i). Petitioner or her trial counsel shall be responsible thereafter for filing and serving any petition for extraordinary writ within 10 days after the record is filed in this court. (See Cal. Rules of Court, rule 8.456.)
