Order - procedures
This matter being ripe for review pursuant to Appellate Rule 61, the Court now DIRECTS as follows: 1. The court reporter, trial court clerk, and parties shall proceed, to the greatest extent possible, under the Indiana Appellate Rules. 2. Special Judge McClamroch shall take all steps necessary to have the trial court clerk assemble the Clerk's Record and issue a Notice of Completion of Clerk's Record, see Ind. Appellate Rule 10, as soon as possible, and in any event no later than thirty (30) days from the date of this order. 3. The due dates for briefs, as provided in Appellate Rule 45(B), shall be triggered by issuance of the Notice of Completion of Clerk's Record. For purposes of briefing, the Council will be considered the appellant and the Judges the appellees. Attorneys for the Council shall prepare any necessary appendix of relevant trial court filings, as provided in Appellate Rules 49 51. No extensions of time for assembling the Clerk's Record or filing briefs will be permitted absent extraordinary circumstances. 4. As of the date of this order, the mandate action was assigned the new Supreme Court cause number that appears at the top of this order, which should be used on all future filings in the matter.
