08/18/2011 #3 ORDER: The defendants filed a petition pursuant to M. G. L. c. 231, § 118 (first par.) seeking interlocutory review of the preliminary injunction granted by the Superior Court on June 20, 2011 (SUCV2011-1381/ McIntyre, J). Upon review, the petition is denied. Because the issues presented merit full panel consideration, I hereby report to a panel of this court my decision denying the petition. See generally, Cassidy v. Comm'r of Environmental Management, 7 Mass. App. Ct. 898, 899 (1979), (discussing scope of authority of single justice to report to full court). The defendants shall be treated as the appellants and plaintiff as the appellee. The Clerk of the Appeals Court shall assemble forthwith the record that was before the single justice and send notice thereof to the parties in accordance with Mass. R. App. P.9(a) and (d). Upon receipt of notice of assembly of the record, the appellant is to forthwith pay to the Clerk of the Appeals Court the requisite docket fee to enter the appeal on the panel docket. The appellants' brief and appendix are to be filed and served on or before September 2, 2011. The appellee's brief is to be filed and served on or before September 23, 2011.
