02/26/2013 #2 ORDER: Before me is the plaintiff's petition, pursuant to G. L. c. 231, § 118 (first par.), seeking interlocutory relief from an order of a judge of the Superior Court denying the plaintiff's motion for class certification. While the issues presented ultimately may be worthy of consideration by an appellate panel after final judgment, I decline to grant interlocutory relief. I note that the judge's decision states that the defendants "are proceeding pro se." However, defendant Around the World Travel, Inc., cannot appear in court without legal counsel. As explained in Varney Enterprises, Inc. v. WMF, Inc., 402 Mass. 79 (1988), except for small claim matters, a corporation may not be represented in judicial proceedings by a corporate officer who is not an attorney licensed to practice law in the Commonwealth. Accordingly, the trial judge may wish to exercise her discretion to ensure that Ms. Boedigheimer is aware of this and other considerations relevant to an informed understanding of self-representation.
