05/26/2011 #5 ORDER: GREGORY J. KANE & another(1) vs. JEAN MARGARET MORESI, M.D. & anther.(2) "The plaintiffs have filed a petition, pursuant to G. L. c. 231, § 118 (first para.), seeking relief from an order of the Norfolk Superior Court (Connors, J.), entered April 7, 2011, on plaintiffs' emergency motion to compel the production of original pathology slides of defendant Caris Cohen DX, PC. The court ordered the defendant to make the original slides available for inspection by plaintiffs' counsel at their present location (Caris Cohen), or at any alternative location which is agreed upon by the parties. The court otherwise denied plaintiffs' motion, including their request for release of the slides to the plaintiffs for inspection by their out of state expert. On April 13, 2011, the court denied plaintiffs' motion for reconsideration. The petition requests that the single justice vacate the order denying their emergency motion to compel. After review of the petition and the defendants' opposition, and the papers filed in the trial court, I discern no error of law or abuse of discretion on the part of the trial court judge in denying plaintiffs' motion.
